Motorcycle Accident FAQs
Q. Where do most motorcycle accidents occur?
A. While you might think the highway is the most frequent location for a motorcycle accident, intersections are actually the most dangerous spots. Other drivers often fail to yield right of way or don’t stop at the light or stop sign.

Q. What kind of injuries do I have to have suffered in order to file a motorcycle accident claim?
A. If you have suffered a serious injury, meaning one that has caused significant damage, pain, and suffering or impacted your daily life, then you may be eligible to file a claim. Some of the more typical motorcycle accident injuries that merit legal action include: traumatic brain injury, spinal cord injury, broken bones, burns and internal injuries.

Q. How can I file a claim if I was injured in a hit-and-run accident?
A. If you were injured by a driver who fled the accident scene, your claim would be filed against your own insurance company according to the uninsured motorist coverage in your policy. This is the same way you would handle a claim if you were hit by a driver who didn’t have any car insurance.

Q. If my accident was pretty straightforward and it’s obvious the car driver was to blame, why do I need a lawyer with trial experience in motorcycle accidents?
A. There are two reasons: Insurance companies tend to offer higher settlements to trial attorneys because a trial will ultimately cost the insurer more money and a good trial attorney won’t hesitate to bring a case to trial in order to recover the most damages for a client. The insurer knows this and wants to avoid this very scenario at all costs. The other reason is that a general prejudice against motorcycle riders does exist and judges and juries tend to assume that motorcyclists are inherent risk takers. You need an experienced trial attorney familiar with representing motorcycle accident victims to present the best, most effective case on your behalf.

Q. What happens if my motorcycle accident was partially my fault?
A. According to Illinois law, if the accident was more than 50% your fault, you cannot file any claim. If you shared less than half the responsibility, however, you can still file a lawsuit. Your damages will be reduced by the percentage the court deems to have been your fault. So if the accident was 10% your fault and the settlement would have been $100,000, you will receive $90,000 instead.

Q. A car turned left in front of me while I was riding my motorcycle and ran right into me. Who is at fault?
A. Illinois law states that a car making a left turn is almost always liable for a collision with a vehicle coming straight in the other direction. Unless you were speeding or ran a red light, you are most likely not at fault.

Q. I have health insurance and have had to use it to pay for medical care as a result of my accident. Does this mean I will get less money from my lawsuit?
A. No, the settlement or damages you receive is based upon your injuries and associated costs – whether you have the means to pay for medical care or not. However, if you did use your health insurance to pay some of those out-of-pocket costs that were incurred because of your accident, your health insurance company may request reimbursement later if you do win your case.

Q. I was injured in a motorcycle accident, but I wasn’t wearing a helmet. Can I still recover damages from the other driver?
A. Illinois law does not require that you wear a helmet while operating a motorcycle, although you are strongly recommended to do so for your own protection. Your decision whether or not to wear a helmet impacts your risk for serious injury in an accident, but it has nothing to do with your right to file a claim against the other driver responsible for your accident.
